Social Entitlement Chamber - ATOS/Department of Work and Pensions (DWP)

All those appeals which require the presence of a medical member of the tribunal arise from decisions made by the DWP.  Most include medical reports prepared by doctors engaged either by the DWP or by ATOS on behalf of the DWP.  Following the decision in Secretary of Work and Pensions v Cunningham [2004] Scot CS 211, the tribunal is unable to deploy medical members who are or who have recently been regularly engaged in the preparation of such reports, in any location where either their own reports may fall to be considered by the tribunals where they themselves sit, or where other judicial office holders with whom they have previously sat may have to consider such reports.
You must be able to demonstrate that your particular circumstances (for example by reason of having moved home and seeking appointment geographically distant from the area where the examinations were carried out) are such that the limitations on your deployment set out above, are of no relevant in the region(s) in which you wish to sit.

Recorder/Deputy District Judge (Magistrates Court) - Crown Prosecution Service Lawyers (CPS)

CPS lawyers are eligible for Recorder or Deputy District Judge (Magistrates Court) posts but the opportunities to sit on criminal cases will be limited, as most prosecutions are brought by the CPS.  Therefore the number of posts available to cover non-CPS work will be limited.  This will be clear on the Vacancy Request and the Information Pack on the JAC website.  Metropolitan Police Office lawyers are similar to CPS lawyers that they are both involved in criminal prosecutions.

First-tier Tribunal, Immigration and Asylum Chamber - Home Office Presenting Officers (HOPS)

Existing Home Office Presenting Officers are not eligible to apply for First-tier Tribunal Immigration and Asylum Chamber exercises, unless they intend to resign from the employment with the UK Border Agency.
