Mercantile Courts are regional courts of the Queen's Bench Division of the High Court. They deal with business disputes that require specialist judges but fall outside the remit of the Commercial Court in London or the jurisdiction of the Chancery Division of the High Court. Matters heard in the Mercantile Court will deal with claims that broadly relate to a commercial or business matter with the majority of cases relating to commercial or professional disputes over contracts or torts, or to issues arising from arbitration claims and awards. Part of this role will involve the promotion of the Mercantile Court in Wales.
The Mercantile Judge will work in a team of which the other members are the
Chancery/Technology and Construction Court Judge and the Designated Civil Judge
for Wales. This post will be based at the Cardiff Civil Justice Centre but the post-holder will be required to undertake frequent travel throughout Wales, and may be required to sit in the Commercial Court in London. As such, it is required that the successful candidate will already be authorised to sit as a Deputy High Court Judge under section 9(1) of the Senior Courts Act 1981, or has the potential to be suitable for authorisation shortly after appointment.
The post is available on a salaried, part-time working basis where a minimum pattern of 80% may be accommodated.
The JAC welcomes applications from solicitors and barristers with at least seven years post qualification experience (PQE). The Lord Chancellor expects candidates to have sufficient directly relevant previous judicial experience. In exceptional circumstances, if a candidate has demonstrated the skills in some other significant way, an exception may be made. Please see the information pack for full details of eligibility.
We also welcome applications from Recorders or those who have held a full-time judicial appointment for at least three years in one of the offices listed in Part 1A of Schedule 2 of the Courts Act 1971.
